The following are the website and mobile application's Privacy Policy for Elite Appliance Service (hereinafter referred to as “Elite Appliance”). By accessing http://www.eliteappliance.ca/ you acknowledge these terms of this Privacy Policy and agree to be bound by them. If you do not agree to these terms, please do not access this site.

Any capitalized terms not herein defined shall take on the definition set out in the Terms and Conditions of service of Elite Appliance (hereinafter referred to as the “T&C”.

This privacy policy is subject to the T&C, where any there is any conflict whether interpretative or procedural between the content of this Privacy Policy and the T&C, the T&C shall govern.

Unless explicitly provided otherwise in this Privacy Policy, this Privacy Policy applies only to the use and transfer of information we collect from you. Elite Appliance has no control over the privacy policies of third parties that may apply to you. 

1.    Collection of Information: you agree that we may collect your personal information from you and third-party sources where applicable. Examples of information collected may include:

a.    Your name, address, telephone number, nature of your principal business or occupation and date of birth, all of which may be required by law;

b.    Identification, such as a valid driver’s license or passport;

c.    Financial information for any payments for the Services provided by Elite Appliance;

d.    Information about your computer or device, operating system, internet connection or telephone account, settings, IP address and device locational data, browser information, and transaction data; 

e.    Any information that you may provide us through any social media accounts;

f.    Any information that you may provide us or to a third-party through our chat/messaging system;

g.    Other information as may be required by law.

Elite Appliance may also use various web tools including cookies, web beacons and/or tagging on our websites and advertisements to evaluate and improve our websites, business operations and/or enhance our customer experience.

Elite Appliance may receive or collect additional information about you from third parties and add this to our account information. This information includes, but is not limited to: demographic data, navigation data, additional contact data and additional data about you from other sources, such as public authorities, to the extent permitted by law.

2.    Use of Information: We may collect your personal information, and use it, and disclose it to any person or organization, including any personnel of Elite Appliance, for the following purposes:

c.    To provide you with ongoing Services;

d.    To provide you with applicable customer service by means of e-mail, telephone, online chat or other methods;

e.    to prevent, detect and investigate potentially prohibited or illegal activities, fraud and security breaches and to enforce our Terms of Use;

Elite Appliance may offer sign-on services that enable you to access the Elite Appliance website or Services with your login credentials. We may also offer Services that enable you to share information with third party social media websites, such as Facebook, Google Plus and Twitter. 

If you provide us access to personal information stored on third party websites, the scope of access to this personal information shall vary per website and will be determined by both your own browser settings and your consent. If you wish to connect your third party account to your Elite Appliance account and you consent to us accessing the information in these third party accounts, you agree that we can collect, use and store information from this third party website in accordance with this Privacy Policy. 

Elite Appliance may keep and use information about you in our records for as long as it is needed for the purposes described in this Agreement, even if you cease to be a Customer.

3.    Disclosure of Information: Elite Appliance may disclose your personal information to third parties in accordance with this Privacy Policy and applicable legislation and regulations. Elite Appliance will not disclose your personal information to third parties for their marketing purposes without your explicit consent. Elite Appliance may disclose your personal information for the following purposes: 

a.    to any service providers of Elite Appliance such as technical support of Elite Appliance or financial services providers of Elite Appliance , which is necessary for Elite Appliance to provide the Services.

b.    If all or a portion of the shares of Elite Appliance are sold to new shareholders, we may release the information we hold about you to the prospective purchaser(s). We will require any prospective purchaser to protect the information provided and to use it in a manner that is consistent with Elite Appliance privacy policy and practices;

c.    a third-party to whom you have given consent for us to disclose information to;

d.    to government authorities where such authorities make inquiries with Elite Appliance for any purpose (subject to any applicable procedures set out by relevant legislation), such as to comply with a court order, for a criminal proceeding, regulatory proceeding or to satisfy other legal procedures.

You agree that all information that you give us will, at any time, be true and complete. If any personal information changes or becomes inaccurate or out of date, Elite Appliance may  require you to advise us so we can update our records.

You agree that we may use the information collected by us to send you offers, whether personalised or not, or to contact you by telephone regarding products or Services offered by Elite Appliance. 

When you no longer wish to receive marketing communications from us, you can, where applicable, change your preferences in your Elite Appliance account, or follow the unsubscribe link in the marketing communication you received. 

When you use our Services, we and our service providers may place cookies (data files on your phone or mobile device’s drive) or web beacons (electronic images that are placed in a web page’s code) or similar technologies. Elite Appliance use cookies to help us identify you as a user, to provide you a better experience on our Website, to measure promotional effectiveness and to ensure trust and safety on our Website.

4.    Refusing and/or Withdraw of Consent: Subject to legal, regulatory and contractual requirements, you can refuse to consent to our collection, use or disclosure of information about you, or you may withdraw your consent to our further collection, use or disclosure of your information at any time in the future by giving us reasonable notice. However, depending on the circumstances, withdrawal of your consent may prevent us from providing you, or continuing to provide you, with certain or all services of Elite Appliance.

We will act on your instructions as quickly as possible but there may be certain uses of your information that we may not be able to stop immediately.

You cannot refuse our collection, use and disclosure of information required by third party service providers essential for the provision of any Elite Appliance services or required by any government authority.

5.    Future Amendments: You acknowledge that we may amend this policy from time to time to take into consideration changes in legislation, technology or other issues that may arise. a.    By posting to the Elite Appliance website;

Your continued use of the website and/or any accounts therein or any Services of Elite Appliance following such change means that you agree to and accept the new terms and conditions of the policy as amended. If you do not agree with any of the changes made or with the new terms of the policy, you must immediately stop using the account, website and/or services noted above and notify us that you are closing your account or terminating your service with us where applicable.
